Before signing a mortgage-support agreement, turn its commitment into calendar dates: when service starts, when the minimum term ends, when renewal occurs, when valid notice must arrive and when service can actually finish. Then list the payments and handover work attached to those dates. A monthly invoice or a “no lock-in” headline does not answer those questions by itself.
This guide helps a brokerage owner prepare a commitment decision for an authorised contract reviewer. It is not a contract template or a conclusion about whether a particular clause is enforceable. The two offers below are entirely fictional, including their dates, fee units and notice rules.
First, collect the agreement that would actually apply
Put the proposed agreement, order form, service schedule and referenced terms together. Record each version and ask which document controls if they conflict. A salesperson's explanation is useful context; ask for any agreed clarification to appear in the documents the authorised parties will accept.
The ACCC explains that acceptance can occur through words or actions, including payment or clicking agreement online. Arrange the review before those steps, rather than treating the signature date as the only possible commitment point.
Keep scope and duration separate. First use the quote-scope comparison worksheet to establish the same preparation tasks, working-hour coverage and broker review responsibilities. Then compare how long each arrangement commits you to buying that work. A shorter commitment may suit uncertain demand; a longer arrangement may suit a settled operating plan. Neither answer follows from the billing frequency alone.
Put five dates on one commitment timeline
Use the following record for each proposed agreement. Copy the relevant clause reference beside every date, and leave uncertain items unresolved until the reviewer or supplier clarifies them.

| Date | What to establish | Mortgage workflow consequence |
|---|---|---|
| Service start | The event and date that start service and charging; check whether onboarding has a different start. | When the processor begins receiving approved tasks, rather than simply receiving a login. |
| Minimum term end | The last date of the initial commitment, including any stated conditions. | How long the brokerage needs a funded workload and review capacity. |
| Renewal date | Whether renewal occurs, its duration and the terms that would apply. | Whether another term begins while hiring or pipeline plans are still being considered. |
| Last valid notice date | The deadline, delivery method, recipient, time zone and receipt rule. | When the owner must decide, not merely when a calendar reminder should appear. |
| Earliest termination date | The actual service end for a specified notice date and permitted exit route. | When replacement coverage and open-file handover must be ready. |
Do not substitute “one month” for “30 days”, assume email delivery counts as receipt or move a deadline because it falls during a holiday. Ask the agreement reviewer how the actual wording works. The business.gov.au contract guide identifies termination circumstances, notice, notice method, money payable and continuing obligations as matters to address.
Use the same cancellation request against two fictional offers
Assume both offers cover the same support scope. Each charges 100 fictional fee units for a full calendar month, payable at month-end. November has been paid; December has not. There are no setup charges, taxes, credits or separately approved exit services in this simplified exercise. Notice is sent by the prescribed email method and acknowledged as received at noon Sydney time on 10 December 2026.
Offer A: service starts on 1 November 2026 and rolls monthly. Notice received by 5 pm Sydney time on the fifteenth ends service on the last day of that month. Later notice ends service on the last day of the next month. Full monthly fees apply through the service end; this example has no mid-month refund.
Offer B: service starts on 1 November 2026 with an initial term ending on 31 January 2027. There is no ordinary early-exit option during that term in this fictional offer. It renews for three months on 1 February unless non-renewal notice is received by 5 pm Sydney time on 1 January. Each later renewal follows the same stated calendar deadline pattern. Full monthly fees apply through the applicable term.

| Result for notice received 10 December | Offer A | Offer B |
|---|---|---|
| Initial minimum term end | No fixed multi-month initial term in this example | 31 January 2027 |
| Next continuation or renewal | 1 January 2027 unless timely notice ends December service | 1 February 2027 unless timely non-renewal prevents it |
| Relevant notice deadline | 15 December, 5 pm Sydney | 1 January, 5 pm Sydney |
| Service end after the request | 31 December 2026 | 31 January 2027 |
| Unpaid service in this exercise | December: 100 fee units | December and January: 200 fee units |
The result is a comparison of the expressly stated fictional rules, not a market price or legal assessment. Offer B's notice prevents the next renewal; it does not shorten the initial term. Offer A still has a notice deadline and a full final month's fee. “Monthly” therefore describes something different in each offer.
Now move the request past the deadline
Repeat the exercise with notice received on 5 January 2027, with all service through December already paid. Under fictional Offer A, notice precedes the fifteenth, so service ends on 31 January and 100 fee units remain for January.
Under fictional Offer B, the 1 January non-renewal deadline has passed. Its stated terms renew service from 1 February to 30 April. Assuming the January notice validly prevents the following renewal, January through April amounts to 400 fee units. This assumes no separately agreed release, breach remedy or other exit route. It does not determine whether the real-world equivalent of that provision would be enforceable.
This second test shows why the decision reminder belongs before the notice deadline. Allocate time for a pipeline forecast, a discussion with the supplier and any necessary advice. A reminder on the renewal date arrives after the fictional decision window has closed.
Calculate exposure without counting the same amount twice
Build a short payment ledger alongside the timeline. Separate unpaid committed service from money already paid and from optional work requiring approval.
- Remaining service: identify the periods, applicable fee basis and payment dates.
- Setup commitments: record any expressly agreed amount and its treatment on the chosen exit route.
- Prepaid balance: establish which service it covers and whether any refund or credit applies; do not add it again as unpaid exposure.
- Exit assistance: distinguish included handover from separately proposed assistance that needs approval.
- Unresolved amount: name the clause, question and person who will confirm it rather than entering zero.
For mortgage work, ask what happens to files accepted before the last service day but not yet ready for broker review. The end of a support agreement is not a promise that every associated loan will have settled. Identify who accepts unfinished preparation, lender follow-ups and outstanding broker questions. Use the provider transition plan once the change has been chosen.
Name the action you want, and escalate uncertain terms
“Cancel” can conceal different requests: stop a renewal, end early, pause work or reduce the scope. Describe the desired outcome and ask which contractual route addresses it. Do not assume that reducing allocated files also reduces committed fees, or that suspending access ends the agreement.
The ACCC's unfair-contract-term guidance explains that the whole contract and transparency matter, and only a court makes the final unfairness decision. Its post-9 November 2023 small-business thresholds are fewer than 100 employees or annual turnover below 10 million Australian dollars for the covered new, renewed or varied standard-form contracts. Ask a lawyer whether the regime and any relevant remedy apply to your actual agreement; do not label every renewal or exit charge unfair.
Finish with a decision someone owns
Record the accepted document versions, five dates, exposure ledger, unresolved questions and decision: proceed, seek amendments or defer. Name the person authorised to accept the agreement and a separate renewal owner with a backup. Store notice evidence with the agreement when notice is eventually given.
Bring the intended support period and reviewed commitment questions into a Mortgage Talent workforce discussion, or share your proposed support brief. Request the applicable agreement for that arrangement. This guide does not state Mortgage Talent's contract terms.
